Total Cost Estimator
Filing is one charge; keeping the registration is several more spaced over a decade. This estimator adds the realistic full cycle: the application itself, the intent-to-use steps if you filed before you had sales, and every maintenance filing needed to stay alive through year ten.
What a ten-year budget actually contains
- The base application fee, $350 per class, plus any surcharge for free-form wording.
- If you filed intent-to-use: the Statement of Use at $150 per class, and possibly extensions at $125 per class each.
- The Section 8 declaration between the fifth and sixth year of registration, $325 per class.
- The combined Section 8 and Section 9 renewal in the ninth or tenth year, $650 per class.
- A $100 per class surcharge if any of those land in the six-month grace period.
Reading the result
The output separates government fees from everything else. Government fees are fixed and published; attorney fees are not, and the tool deliberately leaves them out rather than inventing a rate. If a quoted cost elsewhere is lower, check whether it quietly omits the Section 8 filing, which most comparison tables do.
Every maintenance figure is per class. A registration covering three classes costs roughly three times what a single-class registration costs to keep, every decade, forever. Deleting classes you no longer use before filing a Section 8 is one of the few legitimate ways to cut maintenance cost.
What the estimator does not know
- Whether a surcharge will actually be assessed at filing — that depends on how the application is prepared.
- How many extensions you will need before you can file a Statement of Use.
- Whether you will respond to an Office Action, appeal a final refusal, or face an opposition.
Treat the number as a floor to budget against, not a quote. Real-world total cost rises when the application draws a substantive refusal.
Frequently asked questions
Is renewal cheaper than the original filing?
No. A combined Section 8 and Section 9 renewal is $650 per class against a $350 per class filing. Ten-year ownership of a single-class registration in government fees alone runs about $1,325.
Can I skip the Section 15 declaration?
Yes, it is optional at $250 per class. Filing it after five years of continuous use makes your registration incontestable, which closes off several grounds a competitor could otherwise use to attack it.
Does the grace period make the deadline less dangerous?
It buys six months for $100 per class, and it is not extendable beyond that. Once the grace period closes, a Section 8 that was never filed cancels the registration permanently with no reinstatement route.
